October 13, 2009 Monthly Board Meeting

The regular meeting of the Rosendale Town Board was held on October 13, 2009 in the Rosendale Town Hall. The agenda for this meting was posted at the Town Hall on the bulletin board and the front door and at C & S Player’s LLC and on the town website: www.townofrosendalewi.com.

The meeting was called to order by Chairman Tracy Swayze at 7:30 p.m. The Pledge of Allegiance was recited. Supervisors Jeffrey Miller and Ronald Goeden as well as Clerk/Treasurer Roxanne Tarnow were present. There were 9 electors and 0 guests present. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the agenda. Motion carried (3 ayes). The minutes of the September 8, 2009 meeting were read by the clerk. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the minutes. Motion carried (3 ayes).

PUBLIC COMMENTS
-Richards Mucks, W10953 Triangle Road, Pickett is concerned with the excessive dirt on the roads and about the speed limit on County M. Chairman Swayze has talked with the Fond du Lac Highway Commission in the past about the increased traffic and speed on County M and will talk to them again.

CORRESPONDENCE
-Fond du Lac County Sanitation, Shoreland & Floodplain Board of Adjustment is looking for an alternate member to serve on the board.
-The annual Rosendale Fire Department meeting will be held on Wednesday, October 21, 2009 at 7:00 p.m.
-Robert & Jean Peterson of Sherwood, Wisconsin have had their attorneys Habush Habush & Rottier serve the Town of Rosendale a Notice of Circumstances of Claim. They were involved in an accident at Olden Road and County M on August 16, 2009. They are saying that as a result of the Town of Rosendale’s negligence that they both suffered personal injuries. They are maintaining that the stop sign at the corner of Olden Road and County M may not have been visible enough. The Fond du Lac County Sherriff’s officer stated in his report that the stop sign on Olden Road was about ¼ blocked by tree branches but was still clearly visible. There was also a stop ahead sign on Olden Road. Attorney Sorenson’s Office has provided the Town with an outline of the basic statutory procedures and timelines for a claim against the town. Clerk Tarnow to forward a copy of the claim to the Town of Rosendale’s insurance provider.

TREASURER’S REPORT
The financial report was given by Clerk/Treasurer Tarnow. Vouchers 9016 thru 9027 were paid for a total disbursement of $15,415.18. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the financial report as given and to pay the vouchers. Motion carried (3 ayes).

REPORTS
-None at this time.




OLD BUSINESS
-Chairman Swayze briefly talked about the Fond du Lac County Junk Ordinance and what some of the prohibited activities were. It was decided that the board would pursue those that were in violation of the Ordinance and enforce it.
-Discussion of town properties that are in violation of the Fond du Lac County Ordinance will be table until the board has a chance to inspect the township for possible violations.

NEW BUSINESS
-The Town of Rosendale has received Borree Appraisals contract. At the request of other municipalities they have proposed a three year contract. All services will remain the same. The proposed contract would begin on January 1, 1010 and end on December 31, 2012. The fee would remain the same for 2010 at $8,000.00. For the years 2011 and 2012 the fee would increase to $8,500.00 per year. A motion was made by Supervisor Miller and seconed by Supervisor Goeden to accept the proposed three year contract at the requested fees. Motion carried (3 ayes).
-TRIP Grants are available for the 2010 year. Chairman Swayze suggested holding a special meeting to view the roads for possible projects for the TRIP Grants and to see what possible roadwork needs to be done before winter. They will also make a list of residents, who are in violation of the Fond du Lac County Junk Ordinance, inspect road signs and road name signs for any needed maintenance or replacement. A special meeting for this purpose has been scheduled for Friday, October 16, 2009 at 8:00 a.m. Clerk Tarnow to post this meeting.
-The proposed 2010 Budget Hearing will be held on Tuesday, November 10, 2009 at 7:00 p.m. prior to the regular scheduled monthly meeting.

Next meeting is set for Tuesday, November10, 2009 at 7:30 p.m. at the town hall.

A motion was made by Supervisor Miller and seconded by Supervisor Goeden to adjourn the meeting. Motion carried (3 ayes). The meeting was duly adjourned at 8:35 p.m.
