November 10, 2009 Monthly Board Meeting
The regular meeting of the Rosendale Town Board was held on November 10, 2009 in the Rosendale Town Hall. The agenda for this meting was posted at the Town Hall on the bulletin board and the front door and at C & S Player’s LLC and on the town website: www.townofrosendalewi.com.
The meeting was called to order by Chairman Tracy Swayze at 7:30 p.m. The Pledge of Allegiance was recited. Supervisors Jeffrey Miller and Ronald Goeden as well as Clerk/Treasurer Roxanne Tarnow were present. There were 18 electors and 5 guests present. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the agenda. Motion carried (3 ayes). The minutes of the October 13, 2009 meeting were read by the clerk. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the minutes. Motion carried (3 ayes).
PUBLIC COMMENTS
-Residents commenting over the odor coming from Rosendale Dairy. The item will be placed on December’s board meeting agenda to be discussed.
CORRESPONDENCE
-A notice from WI DNR of an Informational Hearing and Intent to Modify a WI Pollutant Discharge Elimination System (WPDES Permit # WI-0063959-01 for Rosendale Dairy. The hearing will be Held on December 3, 2009 at 5:00 p.m. at Royal Ridges in Ripon.
TREASURER’S REPORT
-The financial report was given by Clerk/Treasurer Tarnow. Vouchers 9031 thru 9042 were paid for a total disbursement of $20,758.35. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the financial report as given and to pay the vouchers. Motion carried (3 ayes).

REPORTS
-A Special Meeting was held on October 16, 2009 to inspect roads for any needed road work before winter, possible work to apply for a TRIP Grant, road signs that may need repair or replacement and road name signs that need replacement. Also a list was made of properties that were in violation of the Fond du Lac Junk Ordinance. A letter has been sent to those residents and they have 30 days from receiving the letter to get the property cleaned up or the matter will be turned over to the Fond du Lac County Code Enforcement Office. One resident refused the letter and after the post office attempted to notify him to pick it up at the post office it was returned to Clerk Tarnow. That letter will be turned over to Fond du Lac County. It was determined that Hickory Lane needs to be wedged and double seal coated and should be used to apply for a TRIP Grant. Road name signs that need replacement were listed and will get ordered for replacement next spring. All road signs will be replaced because by January 2012 all road signs on roads over 25 mph are required to have 6” lettering on them with special reflective tape. Brush will also be trimmed back from the roads.
OLD BUSINESS
-None at this time.
NEW BUSINESS
-A motion was made by Supervisor Miller and seconded by Supervisor Goeden to accept the 2010 Budget. Motion carried (3 ayes).
-Fond du Lac County and Rosendale Fire Department would like to enter an agreement for a Mutual Aid Box Alarm System. This would benefit county residents by coordinating fire protection and emergency medical services. A resolution is needed by the town board before this can occur. Resolution #3-2009 is submitted for board approval. A motion was made by Supervisor Miller and second by Supervisor Goeden to accept the Mutual Aid box Alarm System Agreement. Motion carried (3 ayes).
-Water testing is again being made available to any resident interested at a reduced cost through the town. Clean Water testing staff will be at the town hall on Tuesday, December 15, 2009 from 7:00 a.m.-8:00 p.m. They will be handing out water sample kits that need to be returned that day to the staff. A meeting will be held on Tuesday, January 5, 2010 from 7:00 p.m.-8:30 p.m. for residents to receive their water testing results. If residents are unable to be at the meeting their results will be mailed to them. This information along with pricing will be mailed out with the real estate taxes.
-The contract from Command Central for the hardware maintenance on the election equipment is due for renewal. The contract runs from January thru December 2010 and is $510.00 for the year. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to sign and pay the contract for the 2010 year. Motion carried (3 ayes).
-Chairman Swayze would like to recommend that in 2010 any culverts that need replacing or widening be done. All culverts should be brought up to a standard 18” diameter and 30’ long. Either double wall smooth bore plastic or metal galvanized culverts may be used. Starting in 2011 any repairs to roads that the town deems are needed because of not having a sufficiently large entrance will be billed to the property owner. A letter with this information will be mailed out with the real estate tax information.
-Chairman Swayze looked at and priced new mowers. He will do some further checking and this will be tabled until the December meeting.
-Rosendale Dairy is asking for an extension of their building permit. Attorney Sorenson commented that this has been a large project and they have been showing progress in a reasonable manner. He said that the town was opening themselves up for future issues if this extension was denied. Under normal weather conditions an August 2010 completion date is expected. Chairman Swayze asked if they could provide a construction timeline submitted within two weeks so that the board has an idea of where they are at. A motion was made by Supervisor Miller and second by Supervisor Goeden to extend the building permit for Rosendale Dairy.
-Information was given to the board by a Rosendale Dairy representative in regards to an Industrial Revenue Bond. The dairy is looking at the possibility of securing a revenue bond for manure treatment. The town will need to give permission for the money to be spent here. The dairy is not sure of any definite details yet because they are still pursuing this. Once they have a definite plan for this they will again come to the board. There may be a possible future informational hearing on this.

A motion was made by Supervisor Miller and seconded by Supervisor Goeden to adjourn the meeting. Motion carried (3 ayes). The meeting was duly adjourned at 10:05 p.m.
