June 9, 2009 Monthly Board Meeting

The regular meeting of the Rosendale Town Board was held on June 9, 2009 in the Rosendale Town Hall. The agenda for this meting was posted at the Town Hall on the bulletin board and the front door and at C & S Player’s LLC and on the town website: www.townofrosendalewi.com.

The meeting was called to order by Chairman Tracy Swayze at 7:30 p.m. The Pledge of Allegiance was recited. Supervisors Jeffrey Miller and Ronald Goeden as well as Clerk/Treasurer Roxanne Tarnow were present. There were 6 electors, 1 property owner and 3 guests present. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the agenda. Motion carried (3 ayes). The minutes of the May 12, 2009 meeting were read by the clerk. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the minutes. Motion carried (3 ayes).

PUBLIC COMMENTS
-None at this time.

CORRESPONDENCE
-None at this time.

TREASURER’S REPORT
The financial report was given by Clerk/Treasurer Tarnow. Vouchers 8950 thru 8962 were paid for a total disbursement of $10,561.19. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the financial report as given and to pay the vouchers. Motion carried (3 ayes).

REPORTS
-None at this time.

OLD BUSINESS
-Mark Hoffman, W10633 Triangle Road has submitted an application for a Fireworks Permit to shoot off a few fireworks as well as to sell to neighbors and friends. At the May meeting Mark was asked to have the Rosendale Fire Chief Dave McCoy do a safety check of his fireworks operation. Fire Chief McCoy inspected the property on May 27, 2009. Chief McCoy reported that the storage facility was clean, neat and organized and that he noted no violations. Chairman Swayze granted and signed the Fireworks Permit effective June 9th, 2009 thru July 4th, 2009.
-The Town Board relooked at the road bids that were opened at the May meeting. After discussing the road bids it was decided to award the jobs to the following:
Kopplin & Kinas-Center Road (reestablishing grade-recycled asphalt) for $1,461.00. If Kopplin & Kinas did not take the job it would then go to Ripon Truck & Equipment Repair for $4,800.00.
Ripon Truck & Equipment Repair-Porter Road, Griffith Road and Pierstorff Road (grading-recycled asphalt) for $2,430.00.
Ripon Truck & Equipment Repair-Rose-Eld Road and Olden Road (shouldering-recycle asphalt) for $3,750.00. Ripon Truck is to do Rose-Eld first and then be inspected by Chairman Swayze and if it meets inspection then they can proceed with Olden Road. Supervisor Miller made a motion and Supervisor Goeden seconded to award the contracts to the above mentioned companies. Motion carried (3 ayes).

NEW BUSINESS
-Pickett Steam Engine & Gas Club submitted two applications for Public Celebration/Event Permits for the following events:
Radio Controlled Aircraft Flying-July 19th, 2009
Snowmobile Drag Races-October 30th & 31st, 2009
Supervisor Miller made a motion to grant the permits with the following conditions:
-If there are any problems the Town Board reserves the right to revoke the other applications.
-An insurance certificate needs to be on file
-EMT’s and the Sherriff’s Department are on hand for each event.
The motion was seconded by Supervisor Goeden. Motion carried (3 ayes).
-C & S players LLC, W12010 Rose-Eld Road has submitted applications for renewal of their Alcohol Beverage License, Cigarette License and Operator’s Licenses for Amy Wondra, Cory Nitz and Ashley Johnson. All required fees have been paid and necessary paperwork is on file in the office. Supervisor Miller made a motion and Supervisor Goeden seconded to approve all licenses for C & S Players LLC. Motion carried (3 ayes).
-Pickett Steam Engine & Gas Club, W9975 Olden Road has submitted applications for a Temporary Class “B” License for the Independence Day Tractor Pull on July 3rd, 4th & 5th, 2009 and Operator’s Licenses for Connie Ziebell, Allan Reilly and Henry Rivera. All required fees have been paid and necessary paperwork is on file in the office. Supervisor Miller made a motion ad Supervisor Goeden seconded to approve all licenses for Pickett Steam Engine & Gas Club. Motion carried (3 ayes).
-Clerk Tarnow submitted an ordinance for issuing Temporary Retail Alcohol Licenses. The ordinance numbered 2-2009 would allow for the Town Clerk to issue Temporary Class “B” Beer and Temporary Class “B” Wine Licenses without prior town board approval. The seven day submission of the application for the temporary license for events lasting less than 4 days would still be in effect. At this time the only organization this affects is Pickett Steam Engine & Gas Club. Supervisor Miller made a motion and seconded by Supervisor Goeden to adopt the Temporary Retail Alcohol License Ordinance #2-2009. Motion carried (3 ayes).
-Veolia Environmental Services submitted their contract for a five year term commencing January 1st, 2009. There have been no major changes to the contract. Supervisor Miller made a motion and seconded by Supervisor Goeden to accept the contract. Motion carried (3 ayes).
-The Town Board would like to discontinue town roads that are private driveways if they meet certain criteria. If the driveways are less that ¼ mile and serve only one landowner they would be considered for discontinuance. After looking at the town map it was decided that the following roads would fall under this criteria: Oscola .07 miles, Wiese .08 miles, Morgan .12 miles, Nickoli .07 miles, Club House Drive .10 miles, Getzel .13 miles, Nitz .04 miles, Nitz .06 miles, Lynch .13 miles, Dean .10 miles, Weed .08 miles, Beier .06 miles, Miller .09 miles and Pionke .13 miles. Clerk Tarnow will call the Wisconsin Town’s Association to find out more information on the proper way to proceed to do this.
-Dan Springborn who owns 17.5 acres of property along Highway 26 south of Northwoods Park would like to sell the property. The proposed buyer would like to build a single family home. Mr. Springborn was wondering if it could be rezoned to allow for a home to be built on it. Town of Rosendale Zoning may allow for it be be rezoned as Rural Residential. It was suggested that before they proceed any further that they speak with Sam Tobias at Fond du Lac County Parks and Planning to see if the county would have any issues with this being rezoned.

AGENDA ITEMS FOR NEXT MEETING
-Returning town roads that are private driveways to property owners
-Establishing a fee for Public Celebration/Event Permit Applications

Next meeting is set for Tuesday, July 14, 2009 at 7:30 p.m. at the town hall.

A motion was made by Supervisor Miller and seconded by Supervisor Goeden to adjourn the meeting. Motion carried (3 ayes). The meeting was duly adjourned at 9:20 p.m.
