December 8, 2009 Monthly Board Meeting
The regular meeting of the Rosendale Town Board was held on December 8, 2009 in the Rosendale Town Hall. The agenda for this meting was posted at the Town Hall on the bulletin board and the front door and at C & S Player’s LLC and on the town website: www.townofrosendalewi.com.
The meeting was called to order by Chairman Tracy Swayze at 7:35 p.m. The Pledge of Allegiance was recited. Supervisors Jeffrey Miller and Ronald Goeden as well as Clerk/Treasurer Roxanne Tarnow were present. There were 7 electors and no guests present. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the agenda. Motion carried (3 ayes). The minutes of the November 10, 2009 meeting were read by the clerk. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the minutes. Motion carried (3 ayes).
PUBLIC COMMENTS
-Residents commenting over the odor coming from Rosendale Dairy are concerned with health issues, environmental issues and the quality of the lives. They are being forced into their homes and having to close their windows because of the odor coming from the dairy.
CORRESPONDENCE
-None at this time.
TREASURER’S REPORT
-The financial report was given by Clerk/Treasurer Tarnow. Vouchers 9049 thru 9061 were paid for a total disbursement of $13,481.98. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the financial report as given and to pay the vouchers. Motion carried (3 ayes).

REPORTS
-None at this time.
OLD BUSINESS
-The town is still waiting on quotes for a new mower. A question was raised on the possibility of contracting out the mowing. There is tractor and mower rental available by the week. The cost for that runs $1,800.00 per week. We would provide the operator who would receive ½ day of training. Since we already own a mower that doesn’t seem like an option to pursue. We will table this discussion until January when we should have the quotes.
NEW BUSINESS
-Chairman Swayze handed out a list of contacts who can handle odor complaints. The 1st person to contact is Bill Harke at Rosendale Dairy (920) 766-5335. The 2nd person to contact is Matt Hostak at the DNR (920) 424-7893. The 3rd person is Diane Cappozzo at the Fond du Lac County Health Department (920) 929-3085. Chairman Swayze stated that the Town of Rosendale has no regulatory authority over odor issues. He said that residents need to talk to the DNR and their state representatives and senators. Residents stated that they have talked to the DNR and the Fond du Lac County Health Departments and that they can’t help them. A question was raised about covers for the manure pits and if a provision can be put in the Livestock Siting Ordinance requiring manure covers. Chairman Swayze will look into the matter.
-The following election workers were appointed for the January 1, 2010 – December 31, 2012 term. They are Ross Tarnow and Tammy Wiese (chief inspectors), Laura Coehoorn, Marilyn Stollfuss, Mary Ann Brandl and Cindi Pokorny (poll workers). They will file their Oath of Office and have training on Tuesday, December 15, 2009 from 1:30 p.m. – 2:30 p.m.
-Members were also appointed for the Board of Appeals. They are Mike Whitemarsh for three years who will be chairman. Duane Springborn and Jim Hutchinson will fill the two year positions with Duane being the secretary. One year positions will be filled by David Butler and Jim Zickert. Alternates for 3 years will be Angie Bircholz and Nathan Wiese. Their appointments will begin on January 1, 2010.
-The town has received David Nitz, state licensed building inspectors contract. The contract will be from December 7, 2009 to December 7, 2010. There were some issues with the town providing insurance for Mr. Nitz. It would be an additional $700.00 per year on our insurance to cover him as an independent contractor. We have decided to collect the inspection fees along with the building permit with Mr. Nitz billing the town for his services making him an employee. He will then fall under the town’s insurance coverage with no additional cost.

Next meeting is set for Tuesday, January 12, 2010 at 7:30 p.m. at the town hall.
A motion was made by Supervisor Miller and seconded by Supervisor Goeden to adjourn the meeting. Motion carried (3 ayes). The meeting was duly adjourned at 8:25 p.m.
