April 13, 2010 Monthly Board Meeting
The regular meeting of the Rosendale Town Board was held on April 13, 2010 in the Rosendale Town Hall. The agenda for this meting was posted at the Town Hall on the bulletin board and at C & S Player’s LLC and on the town website: www.townofrosendalewi.com.
The meeting was called to order by Chairman Tracy Swayze at 7:30 p.m. The Pledge of Allegiance was recited. Supervisors Jeffrey Miller and Ronald Goeden as well as Clerk/Treasurer Roxanne Tarnow were present. There were 10 electors and 4 guests present. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the agenda. Motion carried (3 ayes). The minutes of the March 9, 2010 meeting were read by the clerk. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the minutes. Motion carried (3 ayes).
PUBLIC COMMENTS
-None at this time.
CORRESPONDENCE
-Two Public Celebration/Event Applications for Pickett Stream Engine & Gas Club for the Independence Tractor Pull on July 2nd, 3rd & 4th, 2010 and the Steam Engine & Gas Show on September 10th, 11th & 12th, 2010.
-Application for Variance for Curt and Gwen DeHaan, W8989 Oak Road-tear down an existing building and put up a garage. The setbacks do not conform to The Town of Rosendale Zoning Ordnance
-Razing Permit Application for Curt and Gwen DeHaan, W8989 Oak Road- tear down existing building.
TREASURER’S REPORT
-The financial report was given by Clerk/Treasurer Tarnow. Vouchers 9129 thru 9139 were paid for a total disbursement of $ 22,709.57. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to approve the financial report as given and to pay the vouchers. Motion carried (3 ayes).

REPORTS
-The following building permits were issued:
Michael Opheim-N9897 Hickory Lane-indoor riding arena/storage

OLD BUSINESS
-With Ripon Truck & Repair offering the services of a flail mower for $68.00 per hour the purchasing of a new mover will be put on hold. They will repair the old mower and in the fall have Ripon Truck & Repair mow and chop down the brush along the roads. We have approximately 30 miles that needs to be done and for now this will be more cost effective.
-A motion was made by Supervisor Miller and seconded by Supervisor Goeden to turn the following properties over to Fond du Lac County Code Enforcement for violation of the county’s junk ordinance. They have received several letters from the town along with a copy of the junk ordinance. They are Larry Hageman, W11950 Cty Hwy 23, Duane Kimpton, N8096 Cty Hwy M and Larry Batterman, W10805 Rose Eld Road. Motion carried (3 ayes).
-Chairman Swayze, Gary Miller, Town Chairman from Town of Eldorado and Kevin from Ripon Truck & Repair have been unable to get together to take a look at and discuss the combining of some of the snowplowing. Chairman Swayze will pursue this over the summer and this will be tabled until a later date.
Chairman Swayze and Clerk Tarnow visited with Attorney John St. Peter of Edgarton, St. Peter, Petak & Rosenfeldt in Fond du Lac. They spoke with him in regards to what would be expected of him if we were to consider using his office as legal counsel for the Town of Rosendale. Also discussed was the procedure and cost for discontinuing town roads that are private driveways. Their office will be sending us a letter of the Scope and Terms of Representation and a letter in regards to the Legal Representation on the discontinuance of roads. A motion was made by Supervisor Miller and seconed by Supervisor Goeden to retain the services of Attorney John St. Peter and his law firm for legal counsel for the Town of Rosendale and to discontinue the services of the town’s current legal counsel. Motion carried (3 ayes).
-The legal fees for discontinuing town roads will be $5,000.00. Before we can begin the process the roads need to be researched by a title company to make sure that there is only one property owner and that there isn’t a reason that they can’t be returned. The cost of the title company doing the research will be approximately $1,000.00. All roads then need to be surveyed with maps made and published in the newspaper. The cost for the surveying will be approximately $3,500.00. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to proceed with the discontinuance of the 14 town roads that are private driveways. Motion carried (3 ayes).
NEW BUSINESS
-The town board held the annual road inspection on Monday, April 5th, 2010 (see attached lists). There is some minor maintenance work that the town road worker can do and he has been notified and has begun work on it. The board has approximately $85,000.00 to work with. The board determined that the following road work needed to be done and would go out for bids:
-Hickory Lane-.29 mile by 21 feet, approx. 200 ton cold mix wedge, hot oil seal
-Sam Crest Lane-.18 mile by 21 feet plus cul du sac, hot oil seal
-Triangle Road-2 sections for a total of 1 mile, sealcoat, chip and roll
-Olden Road-culvert, 42” plastic double wall for a length of 80 feet, remove old culvert and concrete and install new culvert
-Oak Road-culvert, 48” plastic double wall for a total of 120 feet, remove old culvert and concrete and install new culvert
-Town Hall parking lot-fill cracks and seal coat
-The board felt that the road work on Springbrook Road for $935.00 (black dirt delivered), Hill Road at Rose Eld for $950.00 (clean 110 yards of ditch to proper grade to flow water and remove spoils on north side of road and Getzel Road for $895.00 (remove old section of culvert and install new end and refill with gravel) could not wait. A motion was made by Supervisor Miller and seconded by Supervisor Goeden to have the above mentioned work done as soon as possible by Ripon Truck Repair for a total cost of $2,780.00.
-The two town cemeteries need maintenance work and have collapsing or downed headstones. Chairman Swayze talked with Fred Mattheis who does the moving of the cemetery on Hwy 26. Fred is involved in scouting and in the Rosendale Historical Society. Chairman Swayze thought that maybe a scout or someone in the Historical Society might be interested in working on this. The town would purchase the necessary supplies.
-The board had considered that having a road maintenance truck might be more time economical than always using the tractor for road repairs. With the amount of road work that is needed this year and the lack of funds available this is not something that the board will pursue at this time.

A motion was made by Supervisor Miller and seconded by Supervisor Goeden to adjourn the meeting. Motion carried (3 ayes). The meeting was duly adjourned at 9:05 p.m.
